Proper Use
Apex Investing Institute’s products are owned and operated by Insight Investors LLC. Products and/or Services include all services, materials, information, and content delivered to a subscriber through direct communication, electronic or printed media. Apex Investing Institute’s products are intended for use solely by the individual that has subscribed or purchased products directly from Insight Investors LLC. For the purpose of this agreement Apex Investing Institute and Insight Investors LLC shall be used interchangeably and shall be in reference to the entity Insight Investors LLC.

Subscriber may not allow another person to use subscriber’s username and password to obtain access to Insight Investors LLC products or services for any reason including but not limited to time-share. Subscriber’s rights to use our services or products are limited exclusively to your personal use and may not be resold or shared for free or for profit with anyone.

Intellectual Property Rights
Apex Investing, the Apex Investing Institute Infinity Ball, all Apex Mindset Quadrants, Apex 12 Trading Steps, S3 Formula, P3 Formula and other trademarks used with Apex Investing Institute products, including the apexinvestinginstitute.com website and all sites operated by Insight Investors LLC, are owned by Insight Investors LLC. You may not use or reproduce such trademarks without written permission from Apex Investing Institute. All code, images, content, and media of all types on all sites may not be used for any purpose other than the subscriber’s direct viewing. Apexinvestinginstitute.com and other websites owned by Insight Investors LLC., including the look and feel of such sites. We reserve all rights and remedies available to us and nothing in this agreement is intended to limit our rights and remedies.

Subscriber agrees to not share, resale, distribute, reproduce, copy, sell, resell, provide for free, exploit, or transfer for profit or not for profit any material, services, or access to services and understands that Insight Investors LLC shall bring litigation upon subscriber/customer for any violation of the policies within this agreement and disclaimer and subscriber/customer shall be responsible for all attorney, legal, marketing, public relation, lost profit, travel, damages, and other expense related to such violation. If successive logins are taking place from multiple IP addresses on subscriber account then subscribers account may be suspended and cancelled without refund and subscriber agrees that they shall forfeit any right to a refund and any attempt to chargeback shall result in all collection fees, chargeback fees, subscription fees, and any legal fees being due to company.

Payment Policy & Shipping Methods:

As consideration for the products we provide to you, you agree to pay Apex Investing Institute the applicable fees and other costs set forth at the time you purchase from Apex Investing Institute.

Specials and limited time offers have different fees and costs and may have other terms and conditions.

Prior to your purchase of a product, we may change fees and costs, at any time, for any reason, at our sole discretion, without prior notice to you.

All fees and costs are due at the time you purchase. You agree to pay all value added, sales and other taxes. All payments must be made in U.S. dollars and Canadian dollars for US and Canada customer respectively.

ALL FEES ARE NON-REFUNDABLE, IN WHOLE OR IN PART.

In the event of a charge back by a credit card company (or similar action by another payment provider allowed by us) or other non-payment by you in connection with your payment of the applicable service or renewal fee, you agree that the product for which such fee has not been paid may be suspended, canceled or terminated, in Apex Investing Institute’ sole discretion, and you remain responsible for the full payment of the fee and any additional amounts owed by you.

Apex Investing Institute accepts American Express, Discover/Novus, MasterCard and Visa. We also accept debit cards, personal checks, money orders, cashier checks and wire transfers.

Apex Investing Institute requires the credit, debit, or check card security code for your card for any telephone, on-location or online purchase to protect against the unauthorized use of your credit card by other persons. The security code is an individual three or four digit number specific to your card that may be printed on the face of your card above the embossed account number (if American Express), or on the back of your card, on the signature panel (if Visa, MasterCard or Discover).

Apex Investing Institute accepts cashier’s checks and money orders as valid forms of payment. If you wish to pay by personal check, cashier’s check or money order, you may order by phone at 1-877-273-9007. The personal check, cashier’s check or money order must be payable to Insight Investors LLC.. Apex Investing Institute accepts bank wire transfers as a valid form of payment. If you would like to use a wire transfer to pay for your order, please contact Apex Investing Institute at 1-877-273-9007 and place an order by phone. Please allow at least one business day for the processing of your wire transfer as processing time varies among banking institutions and wire transfers can be delayed due to institution policies.

For payments by check, money order or wire transfer, Apex Investing Institute must receive your payment within 30 calendar days or Apex Investing Institute will cancel your order.

Orders paid by credit card, money order or wire transfer are typically shipped after 3 business days after funds are confirmed cleared and orders paid by check may take up to 15 business days to ship. The estimated shipment date on your order is based on product availability, payment processing time, and warehouse processing time and does not include transit time. Apex Investing Institute does not begin payment processing until Apex Investing Institute receives all of the information that it needs and full payment or a full authorization, in the case of credit card, checks, cashier checks and money orders. Apex Investing Institute will begin payment processing for orders placed on weekends or holidays on the next business day. Business days are Monday through Friday, excluding federal holidays.

Overnight shipment (for delivery within the 48 continental states) of an order is available at extra cost. Your order for in-stock items that are eligible for same-day shipping must be received before 2:00 p.m. Eastern Standard Time, paid by credit card and pending payment processing, with adequate remaining time in the day for your order to be dispatched. Visit Apexinvestinginstitute.com or call customer care agent to set up overnight shipment. This is not available for addresses outside the 48 continental states.

International: Shipping costs for overseas delivery will be provided at the time you place your order. Apex Investing Institute does not guarantee the shipping time for overseas shipment.

Undeliverable Packages: Occasionally packages are returned to Apex Investing Institute as undeliverable. When the carrier returns an undeliverable package to Apex Investing Institute, please contact Apex Investing Institute to make arrangements for reshipment.

Failed Delivery Attempts: Most carriers make three attempts to deliver a package. After three delivery attempts, the carrier will return the package to Apex Investing Institute.

There are no cancellations for current month/term and no refunds on subscription products. Cancellations shall only apply to the following billing cycle after the term the subscriber is currently subscribed to. If you do not renew your subscription and decide to reinstate it then you may be subject to a rate increase depending on what the current rate being charged for the subscription is.

All Apex Investing Institute’ products are non -returnable and non-refundable unless explicitly stated in writing on the product In the event a DVD or CD is defective and/or cracked during shipping, you can contact customer service at 1-877-273-9007. We will ship you the exact DVD/CD the same day if the request came before 2:00 pm EST. Along with the new DVD or CD, we will also send a return to sender envelope with pre-paid postage, which you can use to send us back the damaged DVD or CD. If the damaged DVD or CD is not returned within 14 business days, Apex Investing Institute will charge you the full amount for the new DVD or CD in addition to the original that you have already paid.

Termination
Each of us can terminate our relationship with the other by discontinuing business with the other. For example, we may discontinue your access to Apex Investing Institute’ products in the event you are violating the Terms of Use. However, our rights and remedies under these Terms of Use, including our intellectual property rights, indemnification and limitation of liability, and any other agreement will continue to apply and survive the termination of the relationship. Upon termination, we may disable your access to some or all Apex Investing Institute’ products or services, including if you have violated these Terms of Use. Upon termination, you will not have access to Apex Investing Institute websites.

Miscellaneous
These Terms of Use and any other agreement between Apex Investing Institute and you is governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to principles of conflicts of law. You agree to personal jurisdiction by the federal and state courts located in Federal court Tarrant County, Texas, United States of America, and waive any jurisdictional, venue, or inconvenient forum objection to such courts. If any provision of our agreements is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. These Terms of Use and any other agreements are not assignable, transferable or sub-licensable by you.

If Insight Investors LLC. takes any action to enforce the Terms of Use or any other agreement with you, without limiting any of its other legal or equitable rights and remedies, you shall pay the costs incurred by it in connection with such action, including reasonable attorneys’ fees.

Technology Costs

Many Apex Investing Institute’ products are accessible through the Internet and require that you have a computer and modem or comparable access lines. In addition, text messaging may apply and you will be liable for such cost from your phone provider. You acknowledge and agree that, to the extent necessary for you to access products which are made available through the Internet, it is your responsibility to provide all equipment, including a computer and modem, necessary for you to establish a connection to the Internet; to provide all commercially available standard software necessary to connect with our products; provide for your own connection to the Internet; and pay any costs and fees associated with your equipment, software and connections to the Internet.
